Saipan is part of the Commonwealth of the Northern Mariana Islands (CNMI), where the constitution restricts permanent and long-term interests in land to people of Northern Marianas descent (NMD). If you are not NMD, you generally cannot own land outright. Instead, you can lease private land for up to 55 years (including renewal rights) or buy a condominium unit above the first floor, which the constitution treats as an exception.

Why Is Buying Land in Saipan Different?

The rule goes back to the political agreement that made the Marianas a U.S. commonwealth. Section 805 of the Covenant allows the CNMI government to restrict long-term land interests to people of Northern Mariana Islands descent, as federal court records on the Covenant explain. The purpose is to real estate protect indigenous Chamorro and Carolinian families from losing control of scarce island land.

Who Counts as a Person of Northern Marianas Descent (NMD)?

According to the constitutional text quoted in the CNMI Supreme Court case Ferreira v. Borja, an NMD is a U.S. citizen or national who is at least one-quarter Northern Marianas Chamorro or Carolinian (or a combination), or a person adopted by an NMD before turning 18.

Companies are restricted too. KUAM reported that a corporation can hold land only if all of its shareholders and directors are NMD, so setting up a company is not a simple workaround.

What Can a Non-NMD Buyer Do in Saipan?

Option Available to non-NMD? Key limit
Buy land (freehold) No Reserved for NMD
Lease private land Yes Maximum 55 years, including renewals
Lease public land Yes Maximum 40 years under current rules
Condo above the first floor Yes Exempt from the 55-year cap

Lease private land for up to 55 years

Article XII defines “long-term” as freehold interests and leaseholds longer than 55 years, including renewal rights. So a non-NMD lease must fit inside that window. Many buyers lease a lot and own the house design they build on it, but the land itself reverts to the land property when the lease ends.

    Buy a condominium unit

The constitution carves out an exception for interests acquired above the first floor of a condominium building. A legislative bill reviewed on the CNMI Legislature’s website notes that non-NMD owners can hold such units, though lawmakers have discussed clarifying how common areas and access from the ground floor are treated. A 2007 Attorney General opinion, summarized by a Saipan law blog, found the condominium exception constitutional.

    Lease public land

Public land leases are capped lower. Saipan Tribune reports the maximum is 40 years for public land versus 55 years for private land.

Is the 55-Year Limit Going to Change?

It might, but nothing has changed yet based on the latest reporting I found. In October 2025, a bill known as Senate Legislative Initiative 24-03 proposed extending private home land leases from 55 to 99 years. Marianas Variety reported the sponsor describing it as optional for landowners and aimed at strengthening their bargaining position.

Supporters say longer leases would attract investment. Critics argue a 99-year term could tie up family land for generations. Similar proposals have failed over the years. A constitutional change like this must also be approved by voters, so treat any 99-year lease as not yet available.

The November 2026 constitutional convention vote

Voters were also asked this month whether to hold a constitutional convention. Marianas Variety reported that, according to unofficial results, about 63.7% voted yes but the measure fell 349 votes short of the required two-thirds, so no convention will be held. In practical terms, Article XII stays as it is.

Risks to Know Before You Sign Anything

    • Void leases: A lease that gives a non-NMD more than the allowed term can be struck down. The CNMI Supreme Court, in a case reported as 4 NMI 213, reviewed a lease that a lower court had declared void from the start for violating Article XII, and examined what “renewal right” means.
    • Renewal rights count: Options to extend are added to the total term. A 30-year lease with a 30-year option is already over the limit.
    • Workarounds get scrutinized: In one house floor lease dispute, a judge raised concern about using multiple companies to get around the 55-year cap.
    • Resale value: A leasehold loses value as the remaining term shrinks, which can affect resale and financing.

Step-by-Step: How to Buy Property in Saipan as a Non-NMD

    1. Rent first. Expat guides such as Expat Exchange advise newcomers to spend time on the island before committing.
    2. Decide between a condo and a leased lot. Condos above the ground floor avoid the 55-year cap; leased lots do not.
    3. Hire a CNMI-licensed real estate attorney. Ask them to run a title search and confirm the landowner’s NMD status and authority to lease.
    4. Check the full lease term. Add the initial term and all renewal options together and make sure the total stays within 55 years.
    5. Confirm financing early. Ask local banks how they treat leasehold properties.
    6. Record everything properly and keep copies of all lease and condominium documents.

    Frequently Asked Questions

Can a U.S. citizen buy land in Saipan?

Not unless they are of Northern Marianas descent. U.S. citizenship alone is not enough. Other U.S. citizens can lease land for up to 55 years or buy a condo above the first floor.

Can foreigners buy a house in Saipan?

Foreign nationals face the same limits as other non-NMD buyers: no freehold land, 55-year maximum leases, and condo ownership above the first floor. Immigration status for living on the island is a separate matter to check with the relevant authorities.

How long can I lease land in Saipan?

Up to 55 years on private land, including renewal rights, and up to 40 years on public land under current rules.

Can I buy a condo in Saipan as a non-local?

Yes. Interests above the first floor of a condominium building are exempt from the long-term restriction, though you should have an attorney review the documents and the treatment of common areas.

    Will Saipan allow 99-year leases?

It has been proposed but is not law. Based on the sources above, any extension would still need legislative passage and voter approval.

Can a company buy land in Saipan?

Only if it qualifies as an NMD corporation, which currently requires NMD ownership and directors across the board.

    Bottom Line

You can live in and hold a home in Saipan, but not by buying the land under it unless you are NMD. For most outsiders, the realistic paths are a condo above the first floor or a lease capped at 55 years. The 99-year lease idea is still only a proposal, and the 2026 constitutional convention question did not pass. Get a local attorney involved before you pay a deposit.
